Planning Commission – September 10, 2018

Commissioner Marv Schneider called the meeting to order at 5:30 p.m. and noted that the required public notice
for the meeting was posted. The agenda was approved 3-0. The minutes of the August 6, 2018 Planning
Commission were approved 3-0.
Conditional Use Permit, N2068 Sleepy Lane (Jessica Kroening)
Jessica Kroening and her husband are the owners of the 5.2 acre parcel (02-08-11-5) located at N2068 Sleepy
Lane. Mrs. Kroening applied for a conditional use permit to allow the addition of up to 30 laying chickens for
egg production, 24-36 chicks, and two horses for personal use. Previously she had supplied a packet of
information describing her family’s plan for the housing and caring for the chickens (heritage breed laying hens
with annual hatching of chicks) and future horses, placement of the chicken coop and future barn, and
composting options. She also orally outlined her plans for the animals’ care: a 12 X 20 closed chicken coop
with another 20 foot open area and a proposed horse shelter of 40 feet X 36 feet with both open and closed areas
with access to shelter for the horses at all times. Provisions will be made for readily accessible water for the
chickens and horses.
Chairperson Marv Schneider summarized Jessica’s previous visit to the August Planning Commission meeting
and noted that there had been one neighbor who opposed the addition of the chickens and horses. Four
neighbors were present at the September meeting. Two spoke in favor of allowing the addition of chickens and
horses because similar animals are already present at the properties of other neighbors. One neighbor raised the
question of Mrs. Kroening’s plan to operate a business from her home. She explained that her business was
primarily online with a rare customer coming to the house.
Commissioner Kim Miller noted that one of the concerns at the August meeting had been the presence of
roosters and the noise from crowing. She sought to find a compromise of possible one rooster or no rooster. The
consensus was to allow for one rooster, and if the noise level from crowing was excessive, the property owner
would remove the rooster. Discussion continued on the topic of how long the young chicks would remain on the
premises. It was decided that they could remain until the age of six months, allowing time to find suitable
Kim Miller moved to recommend approval of the Conditional Use Permit to the Town Board with the following
conditions for chickens: 1) allow one rooster, 2) allow up to 30 laying hens, 3) allow 24-36 chicks for up to six
months, and 4) require provision of suitable shelter and accessible water. The following conditions are
recommended for the two horses: 1) construction of an accessible (at least) three-sided roofed shelter, 2)
adequate pasture and exercise area, and 3) water accessible to the horses at all times. Addition CUP conditions
include: 1) plan to compost the chicken and horse manure, 2) a review of the CUP by the county in one year to
assure compliance with the conditions, and 3) the CUP expires with the sale of the property. Motion seconded
by Helen Adams. Motion approved 3-0.
Land Division Discussion, N230 Thornberry Ct (James & Nanette Leland)
James Leland recontacted the Wisconsin Department of Transportation regarding obtaining permission for
another access to serve the three parcels of his prospective land division, and they referred him to the Waupaca
County Highway Department engineer Kyle Fischer. According to the Waupaca County Highway Department
permit signed by Waupaca County Highway Commissioner Casey Byersdorf, the center line of the proposed
access driveway on County Trunk W will be approximately 600 feet from the center line of the south bound
lane of US Highway 45. The new shared access driveway for two of the proposed parcels will have one 40 foot
X 30 inch culvert, and the Leland’s will still be able to use their present access driveway.
Marv Schneider contacted Jason Snyder, Waupaca County Zoning Administrator, who said one Conditional
Use Permit (CUP) will be sufficient to cover the three lots on the eleven acre parcel 02-36-44-2) located at
N230 Thornberry Court. Although there will be three owners, the single CUP requirements will be recorded on
the deed of each parcel.
Commissioners discussed and then recommended to the Leland’s the following process to achieve their goal of
land division with the right to continue agricultural practices. The Leland’s will make an application for a
Zoning Map Amendment to change the parcel from Ag Retention (AR) to Rural Residential (RR). Next they
will apply for a Conditional Use Permit on the eleven acre parcel for planting and harvesting of crops including
hay with no grazing or animal use. Finally, they will have a preliminary Certified Survey Map (CSM) prepared
delineating the three proposed lots, the current driveway, and the new shared driveway for two lots.
The Leland’s will return for the October Planning Commission meeting. There will be one fifty dollar fee for a
contact mailing to neighbors within 300 feet of the property alerting them to the application for a zoning map
amendment. There will also be a one hundred thirty dollar fee for review of the CSM.
Bungert Land Division CSM on High Ridge Lane
At its June18th meeting, the Town Board waived the Waupaca County subdivision ordinance Chapter 37,
Section 8.07 requirement for access to a public road for a nine acre parcel land division on High Ridge Lane
owned by Cindi Bungert. This change was allowed because the new ordinance states that the town may approve
such a division. Subsequently, the Planning Commission received a certified survey map (CSM) for the division
of the nine acre parcel into three lots of 2, 2, and 5 acres respectively. Marv Schneider moved that the Planning
Commission recommend to the Town Board approval of the CSM for the division of the nine acre parcel owned
by Cindi Bungert on High Ridge Lane into three parcels of 2 acres, 2 acres, and 5 acres. Motion seconded by
Kim Miller. Motion approved 3-0.
CSM for Mukwa LLC
Commissioners received a Certified Survey Map for an apparent boundary change on the land. No one was
present to explain the CSM; therefore, Marv Schneider will contact the surveyor requesting him to attend the
October Planning Commission meeting.
Representatives for the Ad Hoc Committee on Frac Sand
Following months of local rumors, Town Chairperson Paula Pagel outlined the Town Board’s plan to establish
an Ad Hoc Committee on Frac Sand to research the future of frac sand mining in Caledonia and its impact on
Town activities. Bill Abba created a draft charter for the group that will be approved at the September 17
meeting of the Town Board. The committee will be composed of town residents, industry representatives,
Planning Commission representatives, and facilitated by Bill Abba, Town Board representative. There will be
two representatives from the Planning Commission: Chairperson Marv Schneider, who was a member of the
committee that created the county’s Non-Metallic Mining Ordinance and Helen Adams, Planning Commission
representative and town resident. The Ad Hoc Committee will begin meeting in October and present its
recommendations to the Town Board in May 2019.

Action Items from the August meeting
? Marv Schneider will contact the Adam Schrader, surveyor for Rosicky Land Surveying and request he to
attend the October Planning Commission meeting to discuss the CSM for Mukwa LLC.
? Commissioners will continue to use the zoning map and the draft future land use map to determine
whether less than 5 acre parcels should be designated as a residential district or an agricultural district.
Commissioners should consider the rationale for retaining Rural Residential-designated parcels when
they are surrounded by agricultural land.
? Commissioners will review parcels in the proposed preferred land use map designated Hamlet
(Readfield) to determine areas to be designated residential and commercial.
? Commissioners should review chapter 4 of the Comprehensive Plan in preparation for discussion during
an upcoming meeting.
